In 2019, American Civil Liberties Union (ACLU) of New Mexico and cooperating attorney, Mark Chaiken (Virtue & Najjar, P.C.), filed a lawsuit in the First Judicial District Court on behalf of Diane Roberts, a transgender diesel mechanic. The lawsuit alleged that Ms. Roberts was wrongfully terminated and discriminated against by ABF Freight System when she was employed there. The lawsuit that was filed has now been resolved without any admission of liability by ABF Freight System. While ABF denies it discriminated against Diane Roberts, ABF says it regrets the way in which Ms. Roberts separated from ABF and she was a valued employee. ABF also says it remains committed to maintaining an environment where everyone is to be treated fairly and with respect and in which discrimination of any kind will not be tolerated. ABF provides ongoing training for its staff on such issues while respectfully serving its communities across the country.
