SANTA FE, NM – Governor Michelle Lujan Grisham signed the Immigrant Safety Act, House Bill 9, into law today, cementing New Mexico's place as a national leader in protecting immigrant communities and refusing complicity in the Trump administration's mass detention and deportation system.

The historic legislation, sponsored by Representatives Eleanor Chávez, Angelica Rubio, Andrea Romero, Marianna Anaya, Senator Joseph Cervantes, and 19 other sponsors, prohibits state and local governments from entering into agreements to detain individuals for civil immigration violations, stops the use of public land for immigration detention, and bans 287(g) agreements that turn local law enforcement into immigration agents. With the Legislature’s passage of the bill and Governor Lujan Grisham’s signature, New Mexico has delivered on its commitment to stand with immigrant families and uphold New Mexico's values of dignity, justice, and community safety.

New Mexico now joins eight other states and numerous localities nationwide that have comprehensively rejected involvement in a deportation system marked by violence, abuse, and death. The legislation comes as ICE has become more dangerous and less accountable than ever – with 32 people dying in ICE custody in 2025 alone, the deadliest year in more than two decades, and at least eight more deaths through interactions with ICE already in 2026.

New Mexico's three detention centers have facilitated this system of harm, with documented cases of excessive use of solitary confinement, inadequate medical care, lack of clean drinking water and food, and five deaths in custody in recent years. The Immigrant Safety Act ensures New Mexico will no longer be complicit in these abuses.

The law also promotes real public safety by ensuring local law enforcement is not entangled in ICE operations through formal agreements – allowing crime victims, domestic violence survivors, and all community members to approach law enforcement without fear. States that have passed similar laws have deportation rates up to four times lower than states that collaborate with ICE.

Advocates across the state celebrated the passage of the bill and thanked the governor and legislative champions for their leadership:

New Mexico will do everything in its power to be a place where all families can live with dignity and safety – where local police focus on keeping communities safe, not acting as deportation agents.
